The Supreme Court of South Korea reached a definitive decision against Ironmace by finding the company responsible for trade secret theft and trademark infringement against the biggest game publisher in South Korea.
The developers created their first game by using secured Nexon assets from a project which Nexon had canceled. The court ordered Ironmace to pay a compensation total of 5.7 billion won which converts to approximately $3.84 million. The financial penalty which Nexon received reduced from 8.5 billion won which the company had originally requested.
The studio faces ongoing legal challenges because a separate criminal investigation into digital asset theft has entered the judicial system. The investigation led to police searches of the Ironmace offices in 2023 so authorities could find evidence of stolen code.
The core of the dispute involves a defunct Nexon project known as P3. Nexon claimed that a former employee took crucial P3 assets including source code to establish Ironmace which developed Dark and Darker. The game launched in Early Access during the summer of 2024 but core intellectual property disputes have continued to impact its development process.
The Supreme Court of South Korea issued its first major legal ruling regarding corporate secrecy violations which resulted in financial damages. The remaining criminal proceedings are being followed closely by industry observers to determine if suspects will receive additional penalties for their data transfer activities.
The financial settlement remains the priority because Ironmace needs to complete this payment according to the 2026 court verdict. The studio has not revealed how this payment of $3.84 million will affect Dark and Darker which is currently receiving support in its transition to full release.
