Epic Games Restores Fortnite to iOS App Store Globally Excluding Australia

Epic Games Returns Fortnite Globally Amidst Apple Anti Trust Inquiries and Commissions Investigations While Battling for Open Payment Systems and Alternative Marketplaces

Epic Games has returned its flagship game Fortnite to the App Store in most of the markets globally. In an official statement on its return Epic Games announced that, the publisher’s return comes amidst an ongoing investigation into Apple's commission rate policies which is underway as part of a larger anti trust inquiry into how Apple levies fees on its developers. The publisher confirmed that, in an effort to pressure the payment systems while legal bodies examine the Apple's business model.

The worldwide return is a direct result of an important legal submission Apple made to the U.S. Supreme Court about the global application of its corporate policies. Apple was fully aware that governments worldwide were observing the US ruling to determine its own policies regarding digital commerce. In the court submission Apple claimed:

Regulators worldwide are scrutinizing this case to ascertain what commission Apple will be permitted to charge on covered purchases outside the USA. Antitrust momentum and legislating abroad.

Epic Games continues its battle against the limitations on third party payment systems imposed by Apple, while remaining resolute to establish open software distribution channels, through alternative marketplaces. Epic Games claims that following the legal investigation, when Apple is forced to reveal its actual expenditure, regulatory bodies will see that the current rates are unacceptable. A lot of positive judicial movement has taken place in numerous other large jurisdictions in which laws are in place, such as the EU, Japan and the UK, aimed at restricting monopolistic software distributions.

However, these new legislative regimes have not done enough to convince Epic Games, who maintains that Apple, despite this progress, has continue to defy these new rules and circumvent the true meaning of the legislation through its complex requirements, warning notices and other mechanisms designed to deter the public from accessing any payment alternative. Epic Games insists that the authorities must actively enforce these rules in order to achieve a reasonable environment for both consumers and developers.

Australia remains the only major territory which has yet to see Fortnite's return to the iOS device platform. Epic Games has secured legal victory in Australia, where the courts ruled that Apple's developer terms were unlawful, however, Apple has refused to yield and enforce those restricted terms within its contracts with local developers. Consequently, the absence of Fortnite from Australian iOS devices will remain as long as Epic Games refuse to conduct business with terms illegalised by the local court. Epic Games is therefore petitioning the Australian court system for a more final order to be passed in regard to enforcing legitimate payment choices in Australia and until this happens, the game will continue to be banned from the Australian App Store.
