A consumer in Brazil successfully sued Microsoft after the technology company deactivated a compromised Xbox account and instructed the user to purchase their digital game library again. The legal battle began when the plaintiff lost access to a personal Microsoft account due to an external security breach. Although support representatives acknowledged the unauthorized takeover during an active investigation they eventually claimed the account was unrecoverable
. Microsoft then deleted the account entirely which wiped out the user digital game collection. The company suggested that the user simply buy all the games a second time to regain access. This led the consumer to seek legal recourse through consumer defense agencies and the special civil court system.
The presiding judge ruled the plaintiff request meritorious
under the Brazilian Civil Procedure Code. The court determined that a platform holder cannot arbitrarily wipe out a consumer purchased library due to a security breach. Microsoft was ordered to reverse the deactivation and unblock the account linked to the plaintiff email within a strict window of 15 days.
The judicial ruling imposes immediate financial consequences on Microsoft for non compliance. If the company fails to restore the account within the 15 day window it faces a daily fine of R$ 150 up to a maximum cap of R$ 1500. Additionally the court ordered Microsoft to pay R$ 2000 in moral damages to compensate the user for the frustration and administrative burden of the ordeal. This sum translates to roughly 400 USD and is subject to inflation adjustments and statutory interest starting from the date Microsoft received the official court summons.
Under Article 523 of the Civil Procedure Code Microsoft faces further penalties if they delay the compensation payment. If the company fails to pay the R$ 2000 within 15 days of the final unappealable judgment the total debt will automatically increase by a 10% fine. The court also indicated that if no new motions are filed within 15 days of the ruling the legal case will be closed. After a storage period of 90 days in the archives the physical records of the case are slated for destruction.
